PainPointPro Terms of Service

1. Acceptance of Terms

By accessing or using PainPointPro (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access the Service. These Terms apply to all visitors, users, and others who access or use the Service, regardless of jurisdiction.

2. Eligibility

To use the Service, you must be at least 13 years of age. By using the Service, you represent that you are at least 13 years old.

3. Accounts and Registration

3.1. Account Creation: You must create an account to access certain features of the Service. You agree to provide accurate, current, and complete information during the registration process.

3.2. Account Security: You are responsible for safeguarding your password and any actions taken under your account. You agree not to disclose your password to any third party.

4. Subscription and Payments

4.1. We offer two subscription options:

  • 5 Credits: $1.49 (one-time payment). This does not include niche analysis
  • Monthly subscription: $3.99/month
  • Lifetime access: $19.99 (one-time payment) This includes all features

4.2. Refund Policy: While lifetime access is generally non-refundable, we comply with UK Consumer Protection Laws. If the Service fails to meet expectations due to technical issues or is not as described, you may request a refund within 14 days of purchase. Refunds are processed in compliance with local consumer laws, such as the UK Consumer Rights Act 2015.

4.3. Cooling-Off Period: You have a statutory right to cancel your subscription within 14 days of purchase, known as the "cooling-off period." This right applies as follows:

  • You may cancel your subscription without giving any reason within 14 days from the day of subscribing to our Service.
  • To exercise this right, you must inform us of your decision to cancel by sending a clear statement via email to our customer service team at support@painpoint.pro.
  • If you have used any premium features during the cooling-off period, we may deduct a reasonable amount from your refund that is proportional to the use of the Service you have already received.
  • Upon cancellation within the cooling-off period, we will reimburse all payments received from you, minus any deductions for use as described above, without undue delay and in any event not later than 14 days from the day on which we are informed about your decision to cancel.
  • We will carry out such reimbursement using the same means of payment as you used for the initial transaction unless you have expressly agreed otherwise.
  • Please note that this cooling-off period does not affect your other cancellation rights as outlined in our cancellation policy.

4.4. Price Changes: We reserve the right to change our pricing at any time. Any changes will be communicated in advance, and users will have the option to cancel before new rates apply.

4.5. Payment Processing: All payments are processed securely by Stripe. By making a payment, you agree to Stripe's terms of service.

5. Credits System

5.1. We may use a credits system for certain features or usage limits. Credits are allocated based on your subscription type.

5.2. Attempting to bypass the credits system may result in account suspension.

6. User Conduct

You agree not to:

  • Violate any applicable local, national, or international law while using the Service.
  • Interfere with the security, integrity, or proper functioning of the Service.
  • Use any automated systems (bots) to access the Service.

7. Intellectual Property

7.1. The Service and its original content, features, and functionality are owned by the creator of PainPointPro (hereinafter referred to as "we", "us", or "our") and protected by international copyright laws and other intellectual property rights. All rights not expressly granted in these Terms are reserved.

7.2. The PainPointPro name and any associated logos are proprietary to the creator of PainPointPro. You agree not to use these in any manner without our prior written consent.

7.3. Nothing in these Terms grants you any right to use the PainPointPro name, or any of our service names, logos, domain names, and other distinctive brand features without our prior written consent.

7.4. You agree not to reproduce, duplicate, copy, sell, resell or exploit any portion of the Service, use of the Service, or access to the Service without our express written permission.

7.5. We do not claim ownership of any third-party content we analyze (e.g., YouTube comments).

8. Data and Privacy

8.1. GDPR Compliance: We comply with the General Data Protection Regulation (GDPR) for users within the European Economic Area (EEA). Users have rights under GDPR, as outlined in our Privacy Policy.

8.2. Data Retention: We retain personal data only for as long as necessary to provide the Service or as required by law. Afterward, personal data will be securely deleted or anonymized.

8.3. Data Security: We use industry-standard measures to protect your data from unauthorized access or breaches. However, no system is 100% secure.

8.4. Third-Party Data Processing: We use third-party services such as Google Analytics and Stripe to help operate the Service. These providers process data under strict data protection agreements.

9. International Use

9.1. While we are based in the UK, the Service is available globally. We do not guarantee compliance with local laws outside of the UK.

9.2. If you are accessing the Service from a country outside of the UK, it is your responsibility to ensure your use complies with local laws.

10. Limitation of Liability

To the fullest extent permitted by law, the creator of PainPointPro shall not be liable for:

  • Any indirect, incidental, or consequential damages.
  • Loss of profits, data, or other intangible assets.
  • Any unauthorized access to your data through our Service.

11. Indemnification

You agree to indemnify and hold the creator of PainPointPro harmless from any claims or disputes arising from your use of the Service, your violation of these Terms, or any violation of applicable laws.

12. Termination

We may terminate or suspend your account if you violate these Terms. Upon termination, your right to use the Service will immediately cease.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United Kingdom, without regard to its conflict of law provisions. However, if you are a consumer residing outside of the UK, you may benefit from certain mandatory provisions of your local law.

14. Changes to Terms

We reserve the right to modify these Terms at any time. If we make material changes, we will notify users via email or an announcement on the website. Your continued use of the Service after changes are made constitutes your acceptance of the new Terms.
